Terms of Service for Maloney's Mowing LLC

Welcome to Maloney’s Mowing LLC! These Terms of Service ("Terms") outline the rules and guidelines for using our services and interacting with our website. By accessing or using our services, you agree to these Terms. If you do not agree, please discontinue use of our services.

1.2 "Services" refer to the landscaping, construction, property maintenance, and related services provided by the Company.
1.3 "Customer" refers to the individual or entity engaging with our services.

2. Scope of Services

2.1 The Company provides landscaping, property maintenance, construction services, and more, as outlined on our website.
2.2 Service availability may vary based on location and resources.
2.3 Additional terms may apply for specific services, and they will be communicated during the service agreement process.

3. Customer Responsibilities

3.1 Customers agree to provide accurate and complete information when requesting services.
3.2 Customers must ensure the service location is accessible and safe for our team to work.
3.3 Customers are responsible for obtaining any necessary permissions or permits for services conducted on their property.

4. Payments and Fees (Updated Section)

4.1 Deposit Requirements:
A deposit of 50% of the total service cost is required upfront to secure the service.

4.2 Payment Schedule:
The remaining balance will be paid in 25% increments, as outlined in the service agreement between the customer and Maloney's Mowing LLC.

4.3 Accepted Payment Methods:
We accept payments through Wix Payments, Apple Pay, Google Pay, Afterpay, Klarna, Tap to Pay, and other methods specified in the invoice.

5. Cancellations and Refunds

5.1 Cancellations must be made at least 24 hours before the scheduled service to qualify for a refund.
5.2 Refunds will be processed within 7-10 business days for eligible cancellations.
5.3 Non-refundable deposits apply to certain services, as specified during booking.

6. Liability Disclaimer

6.1 The Company is not responsible for:

• Delays caused by weather, emergencies, or unforeseen circumstances.

• Damages resulting from pre-existing conditions or issues at the service location.  

6.2 Customers must notify the Company of any issues within 7 days of service completion.

7. Privacy Policy

7.1 By using our services, you agree to the collection and use of your data as outlined in our Privacy Policy.
7.2 Customers can manage their preferences regarding data collection by contacting the Company.

8. Modifications to Services or Terms

8.1 The Company reserves the right to modify or discontinue services at any time, with prior notice when feasible.
8.2 These Terms may be updated periodically, and continued use of services constitutes acceptance of the updated Terms.

9. Dispute Resolution

9.1 Any disputes or claims arising from these Terms shall be resolved through arbitration, as outlined in our contracts.
9.2 Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) in Kansas.

10. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law principles.
